Joe Faucher Participates in Panel: The Current State of ESOP Indemnification

Trucker Huss, APC is pleased to announce that Director Joe Faucher participated in a panel discussion at The ESOP Association’s California/Western States Chapter Annual Conference on October 5, 2018. The panel “The Current State of ESOP Indemnification” discussed recent court decisions, and explored best practices for ensuring that ESOP fiduciaries are protected.

Joe has been litigating ERISA matters and other employee benefit related cases for over 25 years. His litigation experience runs the gamut, and includes defending actions for breach of fiduciary duty against retirement plan sponsors, administrators, trustees and other fiduciaries, claims for benefits against retirement plans, disability insurance plans, health insurance plans and life insurance plans and claims against surety bond companies. He has defended internal trustees and independent trustees in actions involving employee stock ownership plan (ESOP) transactions brought by plan participants and by the United States Department of Labor. In a recent high-profile ESOP litigation matter, Joe’s work was instrumental in bringing about a settlement, on the eve of trial, for a fraction of the plaintiff’s original demand.
