Kim represents plan sponsors, trustees, and other fiduciaries in a wide range of ERISA and employee benefit litigation matters.
Her practice focuses on defending fiduciaries in complex ERISA disputes, including 401(k) and pension class action litigation, claims involving medical and retirement benefits, plan administration disputes, and cases arising under the Mental Health Parity and Addiction Equity Act (MHPAEA). Kim litigates fiduciary duty and benefits claims in federal court on behalf of pension and health and welfare plans.
In addition to her litigation practice, Kim counsels plan sponsors and fiduciaries on fiduciary responsibility, regulatory compliance, and risk mitigation. She advises clients on administrative claims and appeals, reviews denied benefit claims, and provides guidance on ERISA, the Internal Revenue Code, the Affordable Care Act, HIPAA, COBRA, and other applicable federal and state laws governing employee benefit plans.
Kim is admitted to practice before the Northern, Eastern, Southern, and Central Districts of California.
Prior to joining Trucker Huss, Kim worked as a Business Relationship Manager, advising small businesses throughout Northern California on cash flow and risk management. She also externed for Justice Charles E. Wilson of the Sixth District Court of Appeal, where she assisted with regulatory research and drafting opinions on complex issues of California law. While in law school, Kim served as Technical Editor of the University of San Francisco Law Review, Volume 58, was a competition member of the USF Moot Court Team, Vice President of the Asian Pacific American Law Student Association, an Academic Support Program Tutor for Legal Research and Writing, and recipient of the Dean’s Merit Scholarship. In recognition of her oral advocacy, she was named Advocate of the Year for winning the 2022 USF Intramural Advanced Moot Court Competition.
