Trucker Huss Announces New Directors Adrine Cargill and Brian Murray

Trucker Huss, APC is pleased to announce that Adrine Cargill and Brian Murray have been named Directors of the firm, effective July 1, 2025. Adrine concentrates her practice in the area of retirement plans and advises clients on issues regarding 401(k) plans, profit sharing plans, money purchase pension plans, cash balance plans, and traditional defined benefit plans. She also regularly works with multiemployer plans and plans of tax-exempt entities, public schools, and universities, including 403(b) and 457 plans. Adrine serves on the Board of the National Institute of Pension Administrators (NIPA) and is a member of the American Bar Association and Western Pension & Benefits Council. Scott Galbreath Published “What Is A Top Hat Group Depends On Jurisdiction—Plans Should Use A Forum Selection Clause To Avoid Confusion” for the Journal of Deferred Compensation

Scott Galbreath’s article “What is at Top Hat Group Depends on Jurisdiction—Plans Should Use a Forum Selection Clause to Avoid Confusion” was published in the Journal of Deferred Compensation.” The Top Hat plan exception from the Employee Retirement Income Security Act (ERISA) is probably the most important requirement for nonqualified deferred compensation plans. That said, there is very little statutory or regulatory guidance on what exactly is the top hat group, which leaves it to the courts to set parameters.
