We will cover upcoming amendment deadlines, the IRS’s current priority guidance agenda, anticipated SECURE 3.0 developments, and other emerging “hot button” issues plan sponsors and other plan fiduciaries should be focusing on now.
- Litigation Lessons and Minimizing Risks. Recent developments in ERISA litigation (including the latest in 401(k) plan forfeiture litigation), and lessons learned from that litigation about how to best comply with your fiduciary obligations.
- Executive Compensation Update. New developments regarding 457(b) plans and qualified small business stock, and an analysis of current litigation over whether incentive deferred compensation plans for financial advisors are subject to ERISA, and not bonuses exempt from ERISA’s anti-forfeiture rules.
- Fiduciary Trends. A focused discussion on a year of meaningful policy developments shaping the responsibilities of retirement plan fiduciaries. We will explore recent changes affecting permissible investments (including the use of alternative investments), emerging considerations related to the duty to monitor, the Department of Labor’s 2026 national enforcement initiatives, and practical strategies prudent fiduciaries can implement to best ensure compliance with ERISA’s high fiduciary standards.
