Clarissa specializes in the area of employee benefits and ERISA litigation, appearing before federal and state courts at trial and appeals levels. She has handled a wide spectrum of litigation, including cases involving benefit claims, fiduciary issues, plan administration, multiemployer plans, stock option grants, and class action claims. In addition to serving as an advocate in active litigation, Clarissa represents retirement plans, health and welfare plans, and plan fiduciaries in investigations commenced by the Department of Labor and the Internal Revenue Service. She also provides advice and support to plan fiduciaries in their determination of benefit claims and appeals.
Clarissa has given presentations on ERISA litigation and fiduciary responsibility and has authored several published articles, including “The Department of Labor Amends and Supplements Qualified Default Investment Alternative Regulation,” published in July 2008 in the Kiplinger Business Resource Center at www.kiplinger.com, “Recent Court Decision Paves Way for Coordination of Retiree Health Benefits with Medicare Benefits, AARP v. EEOC,” published in Autumn 2007 in the Journal of Pension Benefits, and “New DOL Rules Facilitate the Termination of Abandoned Plans,” published in ASPPA-asap No. 06-18 (June 14, 2006).
