Joseph Faucher, an ERISA litigator and director at Trucker Huss APC, said he’s willing to bet that the Ninth Circuit won’t have the last word on whether arbitration agreements apply to fiduciary-breach claims. He thinks that other circuits will likely weigh in, and “it’s conceivable that other courts of appeal will come to a different conclusion than this one did.”
