Among the changes made by the Veterans Benefits Improvement Act of 2004 was the new requirement that employers provide notice to employees explaining their rights, benefits and obligations (as well as the obligations of the employer) under the Uniformed Services Employment and Reemployment Rights Act of 1994 ("USERRA"). The Department of Labor ("DOL") was required to publish the form of the required notice by March 10, 2005 and has done so, in an interim final rule. All employers should recognize that the notice requirement was effective March 10, 2005, even though the required notice was not issued until that date.
The new notice requirement may be satisfied by displaying the notice where the employer customarily places notices for employees. Employers are also free to provide the notice to employees in other ways that will minimize costs while ensuring that the full text of the notice is provided, for instance by handing or mailing out the notice, or distributing the notice via electronic mail.
